Waiver and Release of Liability

Upon commencing with this program and forever thereafter, you (Buyer) agree that if you engage in any physical exercise or activity you do so at your own risk and assume the risk of any and all injury and / or damage while engaging in any physical exercise or activity. You agree that you are voluntarily participating in this program and assume all risks of injury, illness or damage.

You acknowledge that you have carefully read this waiver and release and fully understand that it is a release of liability, and express assumption of risk and indemnity agreement. You are aware and agree that by executing this waiver and release, you are giving up your right to bring a legal action or assert a claim against Dr. Greg House, PT / Ortho Wellness for any negligence or medical issue which may arise.

In consideration of my use of the exercise program and information provided by the company, I expressly agree and contract, on behalf of myself, my heirs, executors, administrators, successors and assigns, that the company and its insurers, employees, officers, directors, and associates, shall not be liable for any damages arising from personal injuries (including death) sustained by me as a result of the use of the program, regardless of whether such injuries result, in whole or in part, from the negligence of the company.

By the execution of this agreement, I accept and assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type, which may occur to me and I hereby fully and forever release and discharge the company, its insurers, employees, officers, directors, and associates, from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out the use of said instructional materials.

I expressly agree to indemnify and hold the company harmless against any and all claims, demands, damages, rights of action, or causes of action, of any person or entity, that may arise from injuries or damages sustained by me.
I agree to be solely responsible for safety and well-being of myself. I understand that the company does not provide supervision or assistance for the use of the program.

In consideration of the risk of injury while participating in the Ortho Wellness exercise program (the “Activity”), and as consideration for the right to participate in the Activity, I hereby, for myself, my heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily enter into this waiver and release of liability and herby waive any and all rights, claims or causes of action of any kind whatsoever arising out of my participation in the Activity, and do hereby release and forever discharge Greg House, located at 1737 West End Place, Round Rock, Tx 78681, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors, and assigns, for any physical or psychological injury, including but not limited to illness, paralysis, death, damages, economical or emotional loss, that I may suffer as a direct result of my participation in the aforementioned Activity.
In the event that any provision contained within this Release of Liability shall be deemed to be severable or invalid or if any term, condition, phrase, or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect, so long as the clause severed does not affect the intent of the parties.

I understand that Ortho Wellness does not offer or provide physical therapy services and this program should not be used to diagnose or treat pain or illness.

I HAVE READ THE FOREGOING WAIVER AND RELEASE OF LIABILITY AND VOLUNTARILY EXECUTED THIS DOCUMENT WITH FULL KNOWLEDGE OF ITS CONTENT.
